Summary of arbitration:

1) On Arbitration Response Id: 366,119 Colin Behr was given the choice by the arbitrator Amanda, to either claim insufficient progress (in which case RAC would test and award funds appropriately) or continue working with BGeorge. He chose to continue working.
2) A conflict arose between Colin Behr and BGeorge during this process of agreeing upon the deadline and requirements. As a result the arbitration was transferred from Amanda to Rafeek (a technical arbitrator).
3) Rafeek then attempted to resolve this conflict.  He asked for information several times regarding the flaw list from Colin Behr, who did not provide it to him.  Colin Behr was forfeited for non-response.
4) Colin Behr requested a review from a senior arbitrator.  Ian (the senior arbitrator) reviewed the forfeiture and overruled it because he determined that miscommunication caused #3 to occur (not the deliberate lack of following of instructions, as Rafeek has thought).  This occurred on Arbitration Response Id
419,761.
5) The arbitration was restarted.
6) On
Arbitration Response Id: 422,289, Colin Behr was reminded that the 3 day deadline for responses was in effect.  This meant he needed to respond to questions strictly within 3 days or he would forfeit.  This warning was given to him as he had violated the 3 day deadline three times previously: once on this arbitration and twice on a previous arbitration.  He was warned that a 3rd exception would not be given and that forfeiture would be strictly enforced.
7) Colin Behr did not respond with needed information by his deadline of
Friday Sep 8, 2006 2:00:11 AM, and was forfeited.
8) Colin Behr requested and received a review on this forfeiture.  Michele (the senior arbitrator) reviewed it and found the forfeiture was correct.  It was not overturned.
9) After forfeiture, RAC testing determined that 85% of the funds were completed by BGeorge ($255).  The remainder ($45) was returned to Colin Behr.
